1. Acceptance of Terms

By accessing or using Surfaced (“the Service”), operated by Surfaced (“we”, “us”, “our”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Surfaced is an AI visibility monitoring platform that tracks how AI answer engines (ChatGPT, Perplexity, Gemini, Claude, Grok, Llama, Mistral, DeepSeek) mention, cite, and recommend your brand. We provide dashboards, reports, competitive analysis, and optimization recommendations.

3. Account Registration

  • You must provide accurate, complete information when creating an account.
  • You are responsible for maintaining the security of your account credentials.
  • You must be at least 18 years old to use the Service.
  • One person or entity may not maintain more than one free account.

4. Subscriptions & Billing

  • Paid plans are billed monthly in advance via Stripe.
  • All plans include a free score check. No credit card is required to start a trial.
  • You may cancel your subscription at any time. Access continues until the end of the current billing period.
  • Refunds are handled on a case-by-case basis. Contact us within 7 days of a charge for consideration.
  • We reserve the right to change pricing with 30 days' notice. Existing subscribers will be grandfathered at their current rate for at least one billing cycle.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose.
  • Attempt to reverse-engineer, decompile, or extract source code from the Service.
  • Resell, sublicense, or redistribute access to the Service without our written consent.
  • Use the Service to scrape or harvest data in violation of third-party terms of service.
  • Interfere with or disrupt the Service or its infrastructure.
  • Use the API in a way that exceeds reasonable usage or creates excessive load.

6. Intellectual Property

The Service, including its design, code, features, and branding, is owned by Surfaced. Your data remains yours — we claim no ownership of the brands, queries, or content you input. We may use aggregated, anonymized data to improve the Service.

7. Data & AI Platforms

Surfaced queries third-party AI platforms on your behalf. We do not control the responses from these platforms and cannot guarantee their accuracy. AI responses may change over time. Scan results represent a point-in-time snapshot, not a permanent record.

8. Limitation of Liability

The Service is provided “as is” without warranty of any kind. We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Termination

We may suspend or terminate your account if you violate these terms. You may delete your account at any time by contacting support. Upon termination, your data will be deleted within 30 days.

10. Changes to Terms

We may update these terms from time to time. Continued use of the Service after changes constitutes acceptance. For material changes, we'll provide notice via email or the Service.
